A man from Kyoto has filed a lawsuit against a hospital in the city, claiming that his estranged wife presented someone else’s sperm as his and was able to undergo successful fertility treatment using it without his awareness.

The man is seeking damages of ?11 million ($69,000) from the hospital for failing to perform sufficient confirmation before conducting the treatment.

At the first hearing of the suit at the Kyoto District Court on Wednesday, the hospital sought a dismissal, saying that it had provided the necessary explanations regarding the treatment.

According to the complaint, the man and his wife signed a contract with the hospital in 2020?to receive a series of fertility treatments in the hope of having a second child together.

The couple started to live separately in January 2022 and began negotiations for a divorce, but the wife continued to receive the fertility treatment.

After all the couple’s frozen embryos kept at the hospital were used up, she became pregnant through in vitro fertilization using someone else’s sperm that she had said was her husband’s, and gave birth to a baby in August 2023.

The husband was told of her pregnancy in March 2023 during divorce negotiations. He filed a criminal complaint against her in April 2024.

In April 2025, the woman was sentenced to 18 months in prison, suspended for three years, for forging the man’s consent form for treatments conducted after they began divorce negotiations?and submitting it to the hospital. The two later divorced.

The man said the hospital did not contact him or provide explanations to him while the woman was receiving the treatment. He claimed that if the hospital had confirmed his consent in person, he would have recognized that the document had been forged and that the sperm used was not his.

“My right to self-determine whether to have a child was infringed,” he said.

The hospital said there is a factual error in his claims.
